Understanding
Tax Deeds
A Tax Deed is the legal title to
a real property resulting from the sale of that property by a county agency such
as the Treasurer-Tax Collector. When a property owner defaults on paying
their taxes a Tax Lien is issued first against a property. The County will
usually give the owner several extensions allowing a reasonable time to pay
their taxes, even offer to structure a payment plan to bring the taxes current
before resorting to seizing the property and the selling of it at public
auction.
When a property is offered for sale, all junior
liens including mortgages are wiped out. The only liens which survive
are senior liens such as Federal, State and Municipal liens which must be
paid. Careful "Due Diligence" is vital before undertaking the purchase
of a Tax Deed. These properties are offered with this warning
"Caveat Emptor"
or let the buyer beware.
This is because
when you purchase a real property, you also purchase anything that has ever
been recorded against it, including tax liens, judgments and even bankruptcies.
There is a big
difference between a Tax Deed and a Tax Lien Certificate. Tax Deeds are
actual ownership of the property. Tax Lien Certificates are notes
given by the taxing authority for payment of taxes. There is a vast
difference between them.
